WAMBORA PETITION TO BE HEARD IN EMBU.

The High Court has declined to suspend impeachment of embattled Embu Governor by the senate.

Instead wambora petition will be heard by a three judge bench in Embu and not Nairobi.

Council of governors moved to court today to challenge the impeachment of embattled Embu Governor Martin Wambora on grounds that the senate proceedings were conducted in contravention of orders issued by the court.

The suit followed the senates’ publishing a gazette notice dated February 17, 2014 to inform the public of its decision of impeaching Mr. Martin Wambora as Embu Governor.

The petition was before Justice David Majanja who referred the case to Kerugoya High court where the Chief Justice has constituted a three judge Bench.

Council of Governors wanted the High court to issue orders that the embattled Former Governor remains in office until the case is heard and determine.

“This file is hereby taken to the Chief Justice to refer the matter to the three judge bench sitting tomorrow in the afternoon.” Majanja said

COG in their petition says that orders issued by the court on the case of Martin Wambora and the County Assembly of  Embu versus the Speaker of the senate and the attorney General were flouted.

 “There is a strong possibility that the Deputy Governor may be sworn into office anytime pursuant to the impugned Senate impeachment proceedings rendering the suit a nullity hence the urgency,” the petition read in part.

Governors have accused the senate of acting in bad faith by disregarding the orders of the court saying ‘it sets a bad and dangerous precedent’ and that ‘it undermines the rule of law.’

Chairman of Council of Governors, Isaac Ruto, in a sworn statement said that he acknowledges that the senate represents the counties and serves to protect the interests of the counties and their governments

The Chairman of COG further acknowledges in his statement that the constitution provides for the removal of Governors from office on grounds of gross violation of the constitution, and abuse of office.

Bomet Governor Isaac Ruto who is also the chairman of Council of Governors is among the governors listed to appear before the Senate committee.

All governors are meeting today at a Nairobi hotel .Wambora was impeached through a popular senate vote but saved is deputy who is expected to take the embattled governor position after he was send home by the senate.
