High court has halted criminal case against former mungiki leader Maina Njenga pending the hearing and determination of an application before the superior court.
Justice Mbogholi Msagha and Lydia Achode said that since the accused have questions over the criminal charge pending before the lower court, the high court has jurisdiction to hear the application before the trial proceeds.
They said the issue before the lower court is as to whether the accused should be represented senior counsel Paul Muite, which the high court is to make a determination before the hearing of the case goes on.
The judges observed that the accused has right to be represented by an advocate of his or her own choice that the issue for determination.
Njenga and his co-accused are charged with robbery and malicious damage to property which offense they have jointly denied.
