High Court judge Weldon Korir has declined to issue orders to the police to produce the missing Embu Speaker Justus Kariuki Mate
This is after the wife of missing county speaker moved to court seeking to compel the Director of Criminal Investigations and the Inspector General of Police to produce him.
“I agree with your concerns but the court has not been given sufficient information to warrant the summoning of the said top officers, I direct that you provide more information linking the police and the arrest incident,” said Justice Korir.
Sh was directed to give out more information that connects the police to have been directly linked to Mr Kariuki’s disappearance first.
Ms Caroline Wangari Gachema wants her husband produced in court as she claims he disappeared while going to meet a police officer and had therefore been arrested or taken into custody.
Ms Wangari demanded that her husband be released unconditionally and that the court should summon the Criminal investigations, IG David Kimaiyo and the Starehe District Criminal Investigating Officer to confirm whether Mr Kariuki is in police custody as well give an explanation regarding his arrest.
Ms Wangari claims to have made appropriate enquiries at the Director of Criminal investigations, Mr David Kimaiyo and the district criminal investigating officer of Starehe offices but has not been able to access the missing Embu Speaker from any police station or any communication on his whereabouts.
Ms Wangari believes her husband was arrested on Monday evening when he was last seen at Nairobi’s Utalii Hotel within Starehe division.
According to her lawyer Charles Njenga, Ms Wangari is worried that his husband might be subjected to injury, mental anguish and inhuman conditions and that his continued holding has caused anxiety and speculation within the Embu County Assembly.
Justice Weldon Korir directed them to appear before Justice David Majanja. On May 23.
