He told the court through his lawyer Ndegwa Njiru, that the report is erroneous, scandalous and its has been mentioned in criminal case facing former foreigner affairs permanent secretary Mwangi Thuita where he is a witness.
The lawyer told Justice Weldon Korir, that some of the contents of the report were manipulated to concealed the people behind the two brothers who had direct connection at the highest level of government and further stated that Mary wambui her daughter Winnie Mwai were close associates of the two foreigners.
The report was quoted extensively last month in a case where the Governor was testifying against former Permanent Secretary in the foreign affairs ministry Thuita Mwangi and others. The report
claims that Ndathi appears to have been fully in the know and through his invisible hand he fast-tracked the issuance of permits to the Armenian brothers.
It further noted that Mr Stanely Nurage former Permanent secretary and special advisor to the them President Mwai Kibaki was a key player in the saga.
The judge certified the matter urgent and directed that the application be served on attorney general, National assembly and the Clerk to the National assembly and the matter be heard inter parties on 14 August 2014.
