A relative of the Leader of Majority in parliament Mohamed Duale and National Land Commission have been sued for conspiracy to have a candidate’s names removed from Garissa County Land management board.
The aggrieved candidate Abdiladif Ahmed Haret moved to court under certificate of urgency seeking orders to quash the decision of the commission to omit his name.
The applicant through his lawyer Steve Mogaka told the court that, the commission by replacing his name with that of the relative leaders of majority it has usurped the power that is not conferred upon in by the constitution.
The lawyer told Justice Mumbi Ngugi, that, unless the clerk of Garissa county assembly is restrained its likely to present the unlawful altered list to the county assembly for vetting and approval.
Mr Mogaka submitted its the court which has power to direct the commission to follow the right procedure in the appointment person to serve the management board in the respective county assemblies.
He urged the court issue an order to compel the commission to remove the name of Duale and replace it with that of Mr Haret and proper list be forwarded for vatting as required by law.
The court was further asked to issue further order staying the recruitment process, pending the hearing of the petition.
Justice Mumbi certified the application urgent and directed that the same be served and the matter be heard inter parties on 15 Friday August 2014 to determine the dispute.
