High court sitting in Nairobi has halted the director of immigration service from deporting an Ethiopia national to Somali land.
Justice Lenaola issued orders after Mohammed Aden Isamail’s wife Shukr Abdihafid moved to the high court seeking orders to have his husband not to be removed from the country.
The court observed that the Immigration and the minister for National security and Interior co-ordination have given sufficient evidence to show why the subject is being held at Jomo Kenyatta International Airport.
The subject is Ethiopian national working working in Somalia, but reporting to the European Union based in Kenya.
The court heard that the applicant remains detained at the immigration facility at JKIA awaiting orders from the minister for national security and interior co-ordination for his removal out of the country without being given a hearing of his case.
The lawyer appearing for the applicant Mr Billy Amendi told the court that his client was arrested on 12 August 2014 upon arrival at the JKIA while on en route from Somalia and is being held by the immigration officers to date.
He has not be furnished with any informational over the detention or has any criminal charges been preferred against him,, the court heard.
The lawyer told the court that the applicant whose employer Crown Agents limited have confirmed in writing to effect that his their employee there can be no reason to hold him and the government purport to deport him to Somalia while he his Ethiopian national.
The matter will be mentioned on 12 September for further directions.
