High court sitting in Nairobi has sentenced a maid for 10 year-sentence after she was found guilty of killing her Indian employer on September 25th 2009.
Emily shivachi who is now 31 years is said to have killed Kiran kumar shah after she hit her with a stool on the head.
While pronouncing his judgement, Justice Nicholas Ombija however reduced the murder charges to manslaughter saying that there was no malice a fore-thought established in the case. And that Shivachi’s employer Kiran kumar shah the deceased poured water on her face which resulted into a commotion that subsequently led to her death.
Ombija said that the maid was defending herself against her employer. The maid’s lawyer in mitigation told the court that Shivachi has been in custody for five years and suffers a kidney ailment which requires medical attention from time to time.
He further said that the maid is a single mum to an 11 year old son and she is a bread winner to her four brothers and that she is remorseful and has since learn t her lesson.
