LAND COURT TO HEAR DP RUTO’S LINKED HOTEL CASE.

High court has directed a case which businessman Jacob Juma is seeking the revocation of a title deed of a hotel linked to Deputy President William Ruto to be placed before the presiding judge of environment and land matters for further directions.
Lady justice Mumbi Ngugi of constitutional division directed that the case, filed by businessman Jacob Juma, be heard before the Environment and Land division since it deals with land matters..
“Since the case involves land where the establishment has been built, the case is referred to the division for further directions before the presiding judge of environmental and land matter to decide the way forward,” Ngugi said.
In the suit, the outspoken businessman who is a investor in mining industry wants the title deed for the land revoked.
Juma says the land was set aside for the Directorate of Civil Aviation, now the Kenya Civil Aviation Authority.
In court documents, he says stores measuring 0.77 hectares were initially in the site housing sensitive air navigation equipment and spares belonging KCAA.
Juma says the grant issued to Priority Limited and Munene Investments by the Lands commissioner breached public trust when he allotted the property on August 30, 2002.
He adds that KCAA intended to build its headquarters there before the change of ownership.
Mr Juma sometime back through his twitter account posted “WESTON hotel should be given to KCAA to use as an office. We can’t have perennial thugs masquerading as leaders in this country”.
“A development plan had been prepared by the Lands commissioner on January 10, 1991, before the land was transferred to Weston Hotel on June 13, 2007,” Juma says.
In the suit, Juma further says the title deed of the land should have been issued to KCAA to safeguard ownership.
Juma attached letters from the then Transport Principal Secretary Francis Muthaura and his successor Sammy Kyungu, warning that private developers were eyeing the property.
He says Weston Hotel used the prime property strategically located opposite Wilson Airport to secure a Sh485 million loan from Kenya Commercial Bank therefore unjustly enriching itself from public property.
Juma wants Ruto forced to demolish the hotel and surrender the title deed to the National Land Commission for cancellation.
Deputy President William Ruto has confirmed his ownership of the controversial Weston Hotel in Nairobi.
While appearing on Citizen TV’s The Big Question, Deputy President William Ruto said that he owned shares in Weston Hotel but distanced it from the Langata Road Primary School land grabbing scam.
“I have interests in Weston Hotel. I own shares there,” said the DP.
“Weston Hotel has not been accused of any land grabbing at all. The person claiming to be the owner of Langata Road Primary School has a case in court already.”
He said that the hotel stood on an independent land that was bought by him and other partners – whom he did not disclose – from the Airport View Housing Limited.
The Weston Hotel was adversely mentioned in the grabbing of the Langata Road Primary School playground.
The case will now be mentioned before the presiding judge on July 28.
