A litigant has gone to court seeking to stop payment of Sh 1.2 billion to the directors of Afrison Export company limited.
The aggrieved applicant Mr David Mangi Thunga alleges that amount has been partially paid to the company by the national treasury using questionable court orders.
The applicant through his lawyer Danson Mungatana , says the identity of the entities being paid colossal sums of public funds remains a mystery and there is need to clarity before any payment is made
The lawyer who appeared before Justice Isaac Lenaola was directed to argue his case before the commercial division of the high court given that the application raises commercial transactions.
The applicant says that pending the hearing and determination of the suit the court should halt the Attorney General, Afrison limited, Hueland limited, Principal Secretary ministry of Interior and co-ordination of national government, Principal secretary ministry of finance and law firm of Harit Sheth from paying out Sh 1.2 billion to Afrison limited, saying that the respondents have conspired to defraud the National Treasury and Kenya republic by making certain fictitious payments in which Sh.1.8 billion has been paid.
Mungatana argue that the limited company obtained judgment in 2012 through a consent orders, saying general proceeding were fraudulent and manipulated to benefit the Afrison limited.
He says that respondent’s intent to make a further payment of Sh 1.2 billion is being the balance and the court wil be asked to halt such dubious payment until the matter is heard and determined.
Mungatana argue that any further payment by the respondents would be continuation of fraud and theft of public funds.
