Nairobi County Government has filed a petition seeking to stop payment of Sh 2.5 billion as compensation to pave way for the construction of Standard Gauge Railway that is to pass at its parcel of land located along Embakasi Township Reserve.
The County Government says te compensation process should be halted as some people faked tittles to the suit land and have lined up for payments.
The compensation process is to kick off any time due to the strength of a letter by the National Land Commission to the Chief Land Registrar.
The council through lawyer Titus Koceyo, says that the subject land Embakasi Township Reserve L.R No 2955 together with resulting sub-division belongs to NCG, saying fraudster forged and made fake tittles deeds which they have presented to national land commission for compensation.
The lawyer says that if the payment are made NCG will suffer irreparably since the fraudsters are mere sham and paper companies without trace.
“The action if allowed will result to a massive wastage of public funds to the detriment to the resident of the country.
Koceyo says that if the money is paid out to those holding themselves as owners of the parcel of land it would be impossible to recover the same.
The lawyers will be asking the court to certify the application urgent and he heard expeditiously to due circumstance surrounding the compensation.
The application will be placed before vacation judge for directions and orders.
