Embattled pastor of Neno Evangelism Center James Nganga has filed an urgent application seeking to block his prosecution over the accident which occurred along Naivasha- Nairobi road.
The pastor through his lawyers Kam Nyakundi and Cliff Ombeta told vacation judge Justice Weldon Korir, that the director of public prosecution has recommended the prosecution of Mr Nganga.
The lawyers sought for restraining orders to allow them argue the application before action is taken |Nganga.
The judge directed the application be served upon the DPP and inspector general of police and the matter be heard tomorrow by all parties
The lawyers say that its within a public knowledge that on 26 July 2015 there was traffic accident along Naivasha – Nairobi road at a place called Manguo which occurred at 5.30pm involving motor vehicle registration No KCB o6V a Range Rover which is described as Motor vehicle No KBZ 709W.
During the accident a lady identified as Mercy Njeri lost her life and the husband was subsequently injured.
They argue that the inspector general of police issued a statement in which he identified the driver of the Range Rover as Simon Kuria, he simultaneously informed the public that the said driver would be charged in court relation with the accident.
There appears to exist conflicting investigation report which the court will be asked to make a determination before the decisions of the DPP is acted upon, they said.
